ADR consists of
Conciliation
Mediation and
Arbitration.
Conciliation
It is the process of settling disputes outside the courts by way of an agreed settlement or compromise between the disputing parties.
Mediation
It is the process of attempting to achieve an agreed settlement or compromise with the assistance of a mediator, who attempts to facilitate such an agreement. The mediator can not impose the settlement on the disputing parties.
Arbitration
An arbitrator is an impartial referee who makes a legal binding ruling as to the dispute between the parties in the dispute.
These processes are far less expensive than legal processes or litigation and will often result in compromise between parties, especially if the parties can not afford the services of legal practitioners.
